Injury Accidents in Oregon

Injury crashes in Oregon happen multiple times every day. We all get into vehicles on a daily basis in order to get to and from our destinations. In most cases, we take our safety for granted and do not expect to be involved in a serious accident. However, the reality is that these crashes routinely affect innocent victims. This is mostly because of the number of negligent drivers that are on Oregon’s roadways.  These drivers operate their vehicles in a reckless manner, often ignoring traffic laws and failing to account for the safety of themselves and those around them.

If you or a family member have been affected by an injury accident in Oregon, you will want to speak with an attorney concerning your legal rights as soon as possible. Oregon’s injury laws are favorable to crash victims. However, it is normally a mistake to attempt to handle a case on your own. Having an experienced lawyer on your side can make a major difference in the ultimate outcome of your case. The insurance company is not on your side and will try to settle your case as quickly and cheaply as possible. Before you talk to the adjuster, you should obtain legal advice on how to approach your case.

Here at Johnson & Taylor, our experienced attorneys will fight for you during your time of greatest need. We understand the difficulties that you are going through during this time and we are here to help. Our attorneys focus their practice on injury cases so that we can most effectively prepare your claim and assist you in obtaining the maximum possible compensation under the circumstances.

Filing a Wrongful Death Claim in Oregon

In other words, a wrongful death occurs when someone dies as a result of the legal fault of another person or entity. This can happen if they are at fault or negligent, for example, in wrongful Death Lawsuits in Oregon

Oregon has a ‘wrongful death’ law that will allow an individual’s family to file a lawsuit if they died as the result of an accidental or intentional act. Today, we’ll take a look at the major components of Oregon’s wrongful death law including how the statutes define “wrongful death,” who is allowed to file a wrongful death lawsuit and the types of damages available. This article will also cover the time limit for filing such lawsuits.

One law that defines what constitutes a wrongful death is under the state of Oregon, where it is defined as a “death caused by the wrongful act or omission of another,” an act that would have been considered liable had the person not died (Or. Rev. Stat. § 30.020 (2021).) In other words, a wrongful death occurs when one person dies as a result of the legal fault of another person.

As with other types of personal injury lawsuits, the defendant’s liability in a successful wrongful death action is expressed solely in terms of financial compensation (“damages”) that the court orders the defendant to pay to the beneficiary.

This is one major difference between a wrongful death lawsuit and a criminal homicide case, in which a conviction can result in jail or prison time, fines paid to the state, probation, and other penalties. Contacting one of our experienced Oregon wrongful death lawyers will greatly help with navigating this complicated legal process.

Another big difference between a criminal prosecution for homicide and a wrongful death civil lawsuit is that in a criminal case the prosecution must prove the individual’s guilt.

In a wrongful death suit, the victim or their next of kin are only trying to collect damages. Criminal homicide charges often result in jail time, probation, and other penalties – different than those in a civil wrongful death suit.

In a civil lawsuit and to plead not guilty, you have to be found more likely responsible than not for the death. Although most people would never intentionally commit a criminal act that resulted in someone’s death, it can still lead to some serious consequences. That’s because a defendant may be charged with criminal negligence as well as accused of wrongful death in civil court.

Single Vehicle Accidents in Oregon

No one is immune to accidents. Thankfully, Oregon residents are in one of the top states for their safety ranking, but this does not change statistics: over 31,000 people are injured per year in multi-car accidents. This includes victims who suffer injuries as a result of an accident that they did not cause. Irresponsible and reckless drivers cause countless accidents each year- something that any driver can be a part of.

Injuries in car accidents most often occur when two or more vehicles are involved, but single-vehicle crashes can be just as devastating. An injury can be not only painful but expensive as well. It’s important to remember that an injured person may not be able to work, which can lead to problems with their finances. Not only that, but their loved ones – who may have to act as a caretaker in some cases – may also suffer from emotional distress.

Car accidents can be caused by many different reasons. Speeding, driving under the influence, or distracted driving are just some of the most common causes of car accidents. Even if you were partially liable, you may still be entitled to compensation.

Oregon is a state in the U.S. that has some of the most accommodating laws for auto accidents and injury claims. If you were injured in an accident that wasn’t your fault or that you are only partially at fault for, you might be eligible to apply for a compensation claim. An experienced accident lawyer can provide advice and support on what to do if this happens.

Portland, OR (July 24) — The passenger in a car that crashed in a Beaverton yard died Saturday night, the Washington County Sheriff’s Office said.

Yesterday night, Saturday, July 23, a car crashed into a Beaverton yard leaving one passenger dead.

According to reports from the Washington County Sheriff’s Office, the crash occurred on the 19300 block of SW Blanton. Officials noted that the “vehicle that crashed was associated with the yard it crashed in.”

The investigation is still in its early stages and is ongoing. Our thoughts go out to all the victims and their families during this trying time.

Single Vehicle Auto Accidents in Oregon

Car accidents are common. There have been over 31,000 people injured in car accidents in Oregon this year and many of them sustained serious injuries because of the accident. Unfortunately, it can be almost impossible to avoid crashes completely due to the recklessness of other drivers on the road.

Reckless and irresponsible drivers are to blame for many car accidents every year. When this happens, it often leads to severe personal injuries, in which any driver can become involved.

Despite only one vehicle being involved, single vehicle accidents can be very dangerous and even deadly. No one wants to get hurt, especially when being injured also means spending a lot of money, not only for car repairs but also for funeral costs, lost wages, medical bills, etc.

Many different factors can cause car accidents. Speeding, reckless driving, drunk driving, and distracted driving are some of the most common causes. In many cases, you may be eligible to receive compensation from the other party even if you’re partly at fault for the accident.

If you’re injured in an auto accident, you must know your rights and entitlements. In some cases, if you are only partially at fault for the accident or were injured in a non-fault case, you can still file a claim. A personal injury lawyer can be contacted to provide advice and support with this decision.

At Johnson & Taylor Law, we have years of experience in representing accident victims. This means that you can be assured of the highest quality and most efficient service. In this difficult time, your rehabilitation should be your priority and we’re always on hand to help.

Newport, OR – Hit-and-Run Injury Crash on SW 2nd St.

Newport, OR (July 23, 2022) – The Newport Police Department was dispatched to the scene of a hit-and-run crash on Thursday, July 21st. The collision took place around 12:10 a.m. on SW 2nd Street at the intersection with SW High Street.

When officers arrived, they found a 37-year-old Newport man who was bleeding from the head. An investigation revealed that a black 2006 Audi A4 was traveling westbound on SW 2nd. The driver approached the victim, who was on an electric bicycle, and caused a collision. The driver of the Audi left the scene without stopping or providing any medical aid to the victim.

Police later determined that the suspect was a 33-year-old Newport man. They traveled to the driver’s address on NW Spring Street and placed him under arrest for felony hit-and-run. The victim was transported to Samaritan Pacific Communities Hospital for treatment of non-life-threatening injuries.

The crash was investigated by the Newport Police. The Newport Fire Department, Pacific West Ambulance, and Lincoln County Sheriff’s Office also assisted.

No further details are available at this time.

We would like to offer our thoughts and well-wishes to the injured victim following this hit-and-run crash in Newport.

Oregon Injury Accidents

An Oregon injury accident can result in serious outcomes for victims. A hit-and-run accident is a special class of accidents where a driver causes and crash and also fails to remain at the accident scene. By law, drivers are required to stop when they are involved in a collision. If the accident also results in injuries, the driver who leaves the scene can also be charged with a felony. Many hit-and-run accidents are caused by drivers who were driving negligently in the first place and they are also likely to lead to serious injuries.

Following a hit-and-run collision, you should reach out to an experienced attorney as soon as possible. These types of accidents can present complicated legal issues. The driver who hit you may not have car insurance to help pay for your injuries. In this case, it is important to speak with an attorney who can help look for potential coverage from other sources.
