Luckily for accident victims, Oregon is considered one of the most accommodating states for personal injury claims.

Reckless and irresponsible driving accounts for a significant number of auto accidents in Oregon every year. Careless acts such as speeding, distracted driving, and driving under the influence are all common factors in crashes.

Wrongful Death Claims in the State of Oregon

Losing a loved one suddenly in an auto accident can be an unbelievably traumatic time in one’s life. Not only do you have to deal with the trial of processing grief, but there are also numerous financial strains involved as well.

Things like funeral costs, medical bills, and lost income can make the situation even more difficult to cope with. It is in these types of situations that many victims will choose to file what is called a “wrongful death claim”.

A wrongful death, in simple terms, is a legal term for when a person dies as a direct result of the legal fault of another person or entity. Many wrongful death claims are made in the aftermath of an auto accident where one party is killed due to the negligent or reckless driving of another party.

Fortunately, Oregon is known as an accommodating state for personal injury and wrongful death claims. For example, in Oregon, the wrongful death laws make it so that a surviving family member of the deceased party can file on behalf of the victim.

Taking advantage of a free consultation with an experienced Woodburn wrongful death attorney can help out greatly with determining whether or not you have a case.

A wrongful death case is not necessarily a criminal case. In a civil wrongful death case, the amount of liability is determined and the plaintiff will receive financial compensation in terms of “damages”. In a criminal case, the penalty also carries the threat of prison time or other criminal charges.

Here at Johnson & Taylor, our team of seasoned attorneys has worked extensively with victims and families of wrongful deaths and knows what to do to help them get the compensation they deserve.

We offer free consultations so that you can have your legal case assessed without fear of further financial stress. We understand what you’re going through and want to make sure that everything goes smoothly for you. You deserve to focus on your family and healing without worrying about bills and debt.

Do not suffer in silence any longer, continue forward in confidence with a knowledgeable attorney by your side. Get the maximum compensation possible and contact us using the link on our website or by calling (503) 990-6641 to schedule an appointment with one of our attorneys. We are here to help in your time of need.

Marion County, OR — Auto Crash on Ehlen Rd near Butteville Rd Leaves One Dead, One Injured

Marion County, OR (August, 17) — Yesterday, Tuesday, August 16th, at approximately 6:46 am, emergency services responded to reports of a serious auto accident on Ehlen Rd NE, east of Butteville Rd NE near Donald.

It was at that time that the F-150 was struck by the oncoming Ford F-350, which was headed eastbound.

Wrongful Death Claims in the State of Oregon

Most people never expect themselves or a loved one to be involved in an auto accident, let alone an auto accident that proves to be fatal. Dealing with the tragic loss of a loved one coupled with the financial stress of medical bills, funeral costs, and lost income, can make for a very trying time, to say the least. It is in these situations that many will file what is referred to as a “wrongful death claim”.

Put simply, a wrongful death, in the eyes of the law, is when a person dies as a result of the legal fault of another person or entity. Most cases of wrongful death stem from auto accidents, where one part is killed as a direct result of the negligence or recklessness of another driver. Hiring a professional Oregon wrongful death lawyer can help a lot with navigating these complicated legal areas.

In Oregon, the wrongful death laws allow for the surviving family members of the deceased party to file on behalf of the victim. If the case is won, the plaintiff will receive financial compensation referred to as “damages”. The difference between a civil wrongful death case and a criminal case is that the penalty in a criminal case carries the threat of prison time and other criminal charges, whereas a civil suit is about determining liability and gaining compensation.

Our seasoned legal team at Johnson & Taylor has years of experience in helping victims get compensation for wrongful deaths. We offer free legal consultations so that potential clients can have their cases assessed without fear of more financial debt. We know what you are going through and we believe you deserve to focus on your family and healing, not on financial stress.

Wrongful Death Claims in the State of Oregon

Losing a loved one unexpectedly in an auto accident is about one of the toughest things a person could ever go through. Not only are family and loved ones stricken with grief, but there can also be expenses such as funeral costs, memorial services, and lost income. In these events, many will file what’s called a “wrongful death claim”.

A “wrongful death” is defined in Oregon law as a death that is “caused by the wrongful act of omission of another,” when the act or omission would have permitted the person to file a personal injury lawsuit had he or she survived, (Or. Rev. Stat. § 30.020 (2021).

In plain terms, wrongful death is when a person dies directly from the legal fault of another person or entity. In many cases, wrongful death will occur in the form of an auto accident, where one party is killed as a direct result of the negligence or recklessness of another driver.

The wrongful death laws in Oregon allow for the deceased party’s family to file on behalf of the victim. If successful, the plaintiff will receive monetary compensation in terms of “damages”. This is different than a criminal prosecution case where the penalty for the defendant can be time served in prison or other criminal charges.

The truth is that there is quite a lot of information to know when it comes to filing a wrongful death claim in Oregon. If you have just recently lost a loved one to a negligent accident, it is understandable that you probably feel very overwhelmed throughout this process. This is precisely why hiring an experienced Oregon wrongful death attorney is so important.

Here at Johnson & Taylor, we have free consultations available for all potential clients so that they may have their cases assessed by a professional without the fear of yet another giant price tag. Our team knows from years of experience, how to deal with insurance companies and the courts. We know what you are going through and it is our core belief that you deserve to focus on your family, not on bills and legal processes.

We are committed to always being ready and willing to help out victims in navigating these tragic and stressful events. Injury Accidents in the State of Oregon.

Auto accidents are common in our car-centric world, yet it isn’t something most people ever plan for or expect to happen to them. As such, when somebody finds themselves injured after a crash, they often have no idea how to proceed.

Auto accident injuries are life-changing. Not only does one have to cope with whatever physical pain they are in, but they also have to deal with things like medical debts, lost wages from inability to work, and seemingly endless negotiations with insurance companies.

The silver lining for Oregonians is that, in the state of Oregon, filing personal injury claims is a vastly smoother and more accommodating process than in other states. Every year, Oregon sees approximately 31,000 people injured in crashes every year. That includes many victims who were not at fault for causing the collision that created their injuries.

Careless and reckless actions of other drivers on the road cause many accidents and injuries every year. Things like distracted driving, DUIs, and speeding are among the most common forms of reckless driving that cause accidents in Oregon.

In Oregon car accidents, unlike in some other states, a victim can still receive compensation even if they are found partially liable. If you have been injured in an auto accident in Oregon, it is wise to consult with an experienced Oregon personal injury attorney. Not only can a lawyer take a lot off your plate by dealing with insurance companies, and the courts, but they can also help you know if you have a solid case, to begin with.

However, in the state of Oregon, you do not need to be found 100% not liable to receive financial compensation for your damages. This is why it is important to hire an Oregon personal injury attorney. There are many technicalities in personal injury law, and it is nearly impossible to navigate the courts and insurance companies by yourself.

Here at Johnson & Taylor, we have built a practice on the foundational idea that auto accident victims should be able to completely focus on their rest and recovery while we do the heavy lifting. Because of this belief, we offer our clients free consultations so that they may have their cases assessed without any financial anxiety.

Dealing with insurance companies and courts on your own can be a lot of stress on top of your already stressful situation. By hiring a lawyer you’ll not only save valuable time and energy, but you’ll also have a much better chance at gaining your maximum possible compensation.

Our seasoned legal team knows just exactly what you are going through, and we want to make this process as easy and stress-free as possible so that you can focus on your well-being and recovery. Contact us today through the link on our website or by calling (503) 990-6641. Schedule an appointment at your earliest convenience, we are here to assist you in your time of need.
