Wrongful Death Claims in the State of Oregon

Going through the experience of losing a loved one is never easy, regardless of the circumstances. When somebody passes away suddenly and unexpectedly, it can be even harder to cope with the grief. To make matters worse, the process can be very expensive with funeral costs, memorial services, and lost wages.

A “wrongful death” as defined by Oregon law is a death that is “caused by the wrongful act of omission of another,” when the act or omission would have allowed the person to file a personal injury lawsuit had he or she survived, (Or. Rev. Stat. § 30.020 (2021).

Put simply, wrongful death is when somebody dies as a result of the legal fault of another person or entity. Most cases of wrongful death involve auto accidents, where one party is killed due to the negligence or recklessness of another driver on the road.

In Oregon, the wrongful death laws allow for the deceased party’s family to file a lawsuit if the victim died as a direct result of another person or entity’s accidental or intentional act.

A civil wrongful death case is different from criminal prosecution for homicide in that a criminal case can end with jail time and other criminal charges. A civil wrongful death suit typically ends with one party having to pay damages to another. However, a defendant can be sued for both a civil wrongful death and a criminal wrongful death at the same time.

As with other personal injury claims, wrongful death claims are all about determining liability. That liability is expressed in terms of financial compensation, referred to as “damages” that the court orders the defendant to pay to the deceased person’s survivors or estate.

There is a lot to take in, learn, and understand about wrongful death claims in Oregon, and if you have recently lost a loved one, it is understandable for you to feel overwhelmed and lost in the process. That is why it is highly recommended to hire an experienced Oregon wrongful death attorney to help guide you through the process.

Injury Accidents in the State of Oregon

Being injured in an auto accident can be a very trying time in a person’s life. It isn’t something anyone ever expects or plans on happening to them, and the consequences can be life-changing.

The good news is that, in Oregon, the process of filing personal injury claims is much more accommodating than in some other states. On an average year, about 31,000 people sustain injuries from auto accidents in the state of Oregon. Something unnerving to consider is that many of the victims of these accidents were not the ones responsible for the crash.

Many accidents are unfortunately caused by the carelessness of other drivers. Things like reckless and irresponsible driving account for a significant portion of crashes every year. Drunk driving, distracted driving, and speeding are among the most common types of reckless driving that cause accidents in Oregon.

In Oregon car accidents, unlike in some other states, a victim can still receive compensation even if they are found partially liable. If you have been injured in an auto accident in Oregon, it is wise to consult with an experienced Oregon personal injury attorney. Not only can a lawyer take a lot off your plate by dealing with insurance companies, and the courts, but they can also help you know if you have a solid case, to begin with.

Here at Johnson & Taylor, it is our core belief that victims of auto accident injuries should be able to completely focus on their healing and recuperating. We know from years of experience just how hard injuries are on families, which is why we offer free consultations so that there is no financial risk for you to have your case assessed.

Dealing with insurance companies and the courts on your own can prove exhausting, and, likely, you will not receive your maximum possible compensation. With a lawyer by your side, you can rest assured that a professional who knows the ins and outs of the process has your back.

Our seasoned legal team knows just exactly what you are going through, and we want to make this process as easy and stress-free as possible so that you can focus on your well-being and recovery. Reckless and Drunk Driving in the State of Oregon.

Auto accidents happen fast and are not something anybody ever hopes or expects to be involved in. Sadly though, injury crashes are a part of life and happen every day. Some accidents are avoidable though.

Paying attention while driving, obeying speed limits, and being cautious are all great preventive measures. However, some accidents, especially ones involving intoxicated drivers, aren’t as easy to avoid.

The good news is, for Oregonians, Oregon is considered to be one of the most accommodating states for personal injury claims. Every year in Oregon, roughly 31,000 people are injured in auto accidents.

Sustaining injuries from an auto accident involving a drunk driver can be quite tough for the victim. Not only do they have to cope with whatever physical pain they are in, but they can also miss out on work, and rack up significant amounts of medical debt which makes the situation they’re in that much worse.

Contacting an experienced Oregon  drunk driving accident attorney can help out with navigating through these tough situations and receiving the financial compensation you deserve.

Here at Johnson & Taylor, we believe that all victims of vehicular accidents should be able to heal and process the situation calmly, without getting bogged down in dealing with the courts and insurance companies. It’s unlikely for you to get your best deal on your own. We’re tough negotiators with years of experience in mediation and we know how to push hard for a good settlement.

You don’t need to worry about the price tag with us, because we provide free consultations so that you can find out if we’re a good fit for you or not. Injury Accidents in the State of Oregon.

Auto accidents are a fact of life and something that can happen to anyone at nearly any time. Even though auto accidents are such a common occurrence, not many people ever assume it will happen to them, nor are most people prepared to deal with the injuries that can occur.

Luckily for Oregonians, Oregon is one of the most accommodating states for personal injury claims. The state of Oregon sees approximately 31,000 people sustain significant injuries every year from auto accidents. What makes this statistic more unnerving is the fact that many of these victims were not responsible for causing the accident that they were injured in.

Reckless and irresponsible driving is one of the most significant elements of an auto accident, and also the most difficult to be prepared for and react to. Drunk driving, distracted driving, and speeding are all common forms of reckless driving that exist on Oregon roads.

The good news is that even if you are partially at fault in an Oregon auto accident, it is still within the realm of possibilities to receive compensation for whatever damages you have suffered. Consulting with an experienced Oregon personal injury attorney can help you navigate your rights and receive your rightful compensation.

Having a personal injury lawyer by your side is important because injuries have consequences outside of just physical pain. Beyond pain, injuries are also expensive. Expenses like doctor visits, ambulance transportation, surgery, physical therapy, and other costs can quickly add up into a stressful financial burden.

If medical bills and costs weren’t enough, auto accident injury victims often miss out on their normal work shifts. Losing out on wages that a victim would otherwise count on earning, add even more financial stress to an already incredibly stressful situation.

It is important not to allow yourself to feel stuck or trapped in medical debt because of your injuries. Remember that there is always a path forward, and a severe injury does not have to dictate your future. Our team of highly qualified attorneys can help guide you through this process and show you just how many options are still available to you.

Even though, as an injury victim, this is likely the most overwhelming time in your life, hiring a lawyer can be exactly the action necessary to get everything in your life back on track. Trying to deal with insurance companies and the courts while also dealing with an injury is too tall of an order for nearly anyone.

Here at Johnson & Taylor, we strongly believe that all victims of auto accidents should be able to focus on their healing and process the entire situation in peace. It is unlikely for you to receive your maximum possible compensation on your own. Our team has years of experience dealing with insurance agents and the courts, and we know how to be tough negotiators.

There is absolutely no financial risk for you to consult with one of our attorneys. We offer free consultations to all of our potential clients so that they may have their cases examined without the stress of yet another outrageous price tag. From your free consultation, we can assess what compensation you can receive and help you plot a way forward.

Our seasoned legal team knows just exactly what you are going through, and we want to make this process as easy and stress-free as possible so that you can focus on your well-being and recovery. Auto Accidents in Oregon

Auto accidents are an unfortunate part of life that anyone can be a part of. The good news is that, for Oregonians, the state of Oregon is considered to be one of the best states for accommodating personal injury victims.

Every year in the state of Oregon, there are approximately 31,000 people every year who suffer injuries in auto accidents. Something staggering to consider is the fact that many of these victims were not at fault for the collision. Crashes are often something completely out of a driver’s control.

One of the biggest causes of auto accidents in the state of Oregon is irresponsible and reckless drivers. Things like speeding, distracted driving, and driving under the influence are all common forms of reckless driving that can have serious consequences. However, even if a driver is partially responsible for a crash, they may still be able to receive compensation. Consulting with an experienced Oregon auto accident lawyer can help make this process clearer for you.

Injuries are a serious matter, not only because of the physical pain they can come with but also because of their financial burden. Things like doctor appointments, surgeries, and loss of work can all tally up to quite a hefty price tag.
