Wrongful Death Claims in the State of Oregon
Losing a loved one unexpectedly in an auto accident is about one of the toughest things a person could ever go through. Not only are family and loved ones stricken with grief, but there can also be expenses such as funeral costs, memorial services, and lost income. In these events, many will file what’s called a “wrongful death claim”.
A “wrongful death” is defined in Oregon law as a death that is “caused by the wrongful act of omission of another,” when the act or omission would have permitted the person to file a personal injury lawsuit had he or she survived, (Or. Rev. Stat. § 30.020 (2021).
In plain terms, wrongful death is when a person dies directly from the legal fault of another person or entity. In many cases, wrongful death will occur in the form of an auto accident, where one party is killed as a direct result of the negligence or recklessness of another driver.
The wrongful death laws in Oregon allow for the deceased party’s family to file on behalf of the victim. If successful, the plaintiff will receive monetary compensation in terms of “damages”. This is different than a criminal prosecution case where the penalty for the defendant can be time served in prison or other criminal charges.
The truth is that there is quite a lot of information to know when it comes to filing a wrongful death claim in Oregon. If you have just recently lost a loved one to a negligent accident, it is understandable that you probably feel very overwhelmed throughout this process. This is precisely why hiring an experienced Oregon wrongful death attorney is so important.
