Our thoughts are with James Sheehan and their family at this time. We wish them the best in getting through this hard time.

Wrongful Death Lawsuits in Oregon

Milwaukie, OR — Fatal Motorcycle Accident on Hwy. 99E, Clackamas Co

In Oregon, wrongful death claims can be made for monetary damages when a person dies under certain circumstances. The law in Oregon allows for claims or lawsuits related to wrongful death when it has been proven that the death was a result of someone else’s negligent, reckless or intentional actions.

Under ORS 30.020, a person’s estate can make wrongful death claims on behalf of the deceased. It is not unheard of for step-parents, or a step-child to also qualify as beneficiaries in a decedent’s wrongful death claim.

The party representing the estate of a deceased person in an Oregon wrongful death case can seek compensation for all expenses related to the person’s death. Unplanned costs in the unfortunate event of a death can go away from just medical costs. You might also need to cover funeral or memorial expenses, or a loss of wages for your deceased due to injury. Luckily, these can all be covered by wrongful death compensation.

You may be entitled to future income based on how much an individual was expected to make in their life. If you’re appointed a representative, keep in mind that you can sue for this lost income. If a person dies due to an injury caused by another individual, then any lost medical insurance, pensions, and other pecuniary losses can also be compensated for in a wrongful death claim.

Decedent beneficiaries might also want to sue for loss of companionship and society, but the payout will not exceed $500,000. Punitive damages may be recovered when the deceased’s death is caused by the reckless, egregious, or intentional conduct of the at-fault party.

If you have lost a loved one to a preventable death at the hands of someone else’s negligent actions, consider hiring an experienced Milwaukie wrongful death lawyer. Don’t navigate this difficult situation alone, proceed confidently with a professional by your side.
