Wrongful Death Claims in the State of Oregon

Losing a loved one suddenly in an auto accident can be an unbelievably traumatic time in one’s life. Not only do you have to deal with the trial of processing grief, but there are also numerous financial strains involved as well.

Things like funeral costs, medical bills, and lost income can make the situation even more difficult to cope with. It is in these types of situations that many victims will choose to file what is called a “wrongful death claim”.

A wrongful death, in simple terms, is a legal term for when a person dies as a direct result of the legal fault of another person or entity. Many wrongful death claims are made in the aftermath of an auto accident where one party is killed due to the negligent or reckless driving of another party.

Fortunately, Oregon is known as an accommodating state for personal injury and wrongful death claims. For example, in Oregon, the wrongful death laws make it so that a surviving family member of the deceased party can file on behalf of the victim.

Taking advantage of a free consultation with an experienced Woodburn wrongful death attorney can help out greatly with determining whether or not you have a case.

A wrongful death case is not necessarily a criminal case. In a civil wrongful death case, the amount of liability is determined and the plaintiff will receive financial compensation in terms of “damages”. In a criminal case, the penalty also carries the threat of prison time or other criminal charges.
