How long do I have to file a wrongful death claim, and what kind of damages can I recover?

Oregon law requires a wrongful death claim to be filed within three years of the death of the decedent (ORS 30.020), but the timeframe could be shorter depending on when the injury causing the death occurred. Oregon law allows damage awards for the following:

  • Medical and burial services
  • Loss of income and pain and suffering for the time between the injury and the death
  • Pecuniary loss to the decedent’s estate
  • Loss of companionship and lost wages for the decedent’s family members
  • Any punitive damages to which the decedent was entitled had the person survived
